How sales work
What each kind of sale sells, and how you buy.
Plain notes taken from the notices and agency pages we read, each with its link. They describe the usual process; the notice for a given sale controls, and terms change. They are not legal advice.
Kind 1
Texas county tax sales

- What is sold
- Land, and sometimes a mineral or working interest assessed for tax, after a court judgment for unpaid taxes. A resale offers property the taxing units bid in at an earlier sale and hold in trust.
- When and where
- The first Tuesday of the month, between 10:00 a.m. and 4:00 p.m., at a place the commissioners court sets. The sheriff or a constable conducts it. Some counties sell online instead.
- How bidding works
- Register before the sale with an identification card, bid out loud, and pay the full bid the same day by cashier's check or money order. The bid sheet gives a minimum bid for each tract.
- What you get
- A sheriff's or constable's deed without warranty. The former owner can redeem: for two years on a homestead, agricultural land and mineral interests, and for 180 days on other property, per the Panola County notice. Taxes after the judgment are on the buyer.

New Mexico delinquent property tax auctions

- What is sold
- Real property, sold by the state Property Tax Division for delinquent property taxes, county by county.
- When and where
- No set schedule. The division sets a county's sale once its title research is done and posts it with the list. It does not hold sales in all 33 counties each year.
- How bidding works
- Register on the day of the sale; registration closes when the sale starts. Bidding is oral, in person or through an agent with a notarized authorization.
- What you get
- A tax deed the division describes as equal to a quitclaim deed: the former owner's interest as of the date the tax lien arose, subject to interests recorded before that. The state gives no title warranty. The former owner has two years to challenge the sale in court. The only redemption period is the 120 day federal IRS period: if the federal government holds a lien on the property, it may redeem within 120 days of the sale.
Kind 3
Oklahoma resales and county owned property

- What is sold
- Land on which the county has held a tax lien for two full years. A resale is an outright purchase of the property.
- When and where
- Each year on the second Monday of June, at the county treasurer's office. Several county treasurer pages, including Beckham's, say an amendment to 68 O.S. Section 3105 ended the October certificate sale.
- How bidding works
- Auction to the highest bidder. The bid starts at the delinquent taxes, penalties, fees and costs.
- What happens to the rest
- Property that draws no bid is deeded to the county. The treasurer may then sell it with the county commissioners' approval (68 O.S. Section 3135); each county posts its list and how to offer.
Kind 4
Louisiana adjudicated property auctions

- What is sold
- Property placed in a parish's or city's hands because its taxes were not paid and no one bought it at a later tax sale. It usually does not come up for another tax sale; the parish can sell it to a private buyer.
- When and where
- An auction is set after someone makes a written minimum bid on a parcel. The administrator posts the date; dates can change or be cancelled.
- How bidding works
- The auction is public, but only registered bidders take part. You register and pay the administrator's fee before the auction date. If no one else registers, the written bid wins.
- What you get
- Read the parish's terms and the act of sale for what conveys, including any reservation of minerals, before you register.
Kind 5
State oil and gas lease sales

- What is sold
- A lease on minerals the state owns: the right to explore and produce for a primary term, for a cash bonus, rentals and a royalty to the state. Not the minerals themselves.
- Texas General Land Office
- Online sealed bid sale on EfficientMarkets.com. Tracts come from nominations; bids are opened on sale day and results are announced at the School Land Board meeting.
- New Mexico State Land Office
- The third Tuesday of every month. Sealed bids online through Efficient Markets (EnergyNet); bidders need an OGRID number. The October and November 2026 notices give a five year term; the royalty is one fifth on the Chaves County tracts and one quarter on the October Eddy and Lea County tracts.
- Louisiana State Mineral and Energy Board
- Usually the second Wednesday of the month in Baton Rouge. Tracts are nominated, then advertised; sealed bids are due by noon on a set day before the sale and are opened in public. The board leases state lands, water bottoms and land adjudicated to the state at tax sale, without warranty.
- Oklahoma Commissioners of the Land Office
- Not listed here: the agency's website asks automated readers to stay off the site.
Kind 6
Federal (BLM) oil and gas lease sales

- What is sold
- A federal oil and gas lease on federal minerals, parcel by parcel, each with its stipulations.
- When and where
- Each BLM state office holds sales quarterly when parcels are eligible. The New Mexico State Office covers New Mexico, Oklahoma, Texas and Kansas. Eastern States has offered Louisiana parcels, including Webster and Bossier parish parcels proposed for March 2027. Sales are online.
- Before the sale
- Parcels go through scoping and a comment period, then a sale notice about 45 days ahead with a protest period. The notice lists the parcels and stipulations.
- How parcels get there
- Industry nominates land through an expression of interest.

Before you bid, have the county records run on the tract: a runsheet of the instruments in its chain, delivered as a land packet.
